TVA Section 26a Permits for Docks on Lake Guntersville

A reference document: what needs a permit, what it costs, how long it takes, and the size, boathouse, flotation and dredging limits that decide what can actually be built.

Scope

What needs a permit

Section 26a of the TVA Act, with regulations at 18 CFR Part 1304, requires TVA approval before construction, operation or maintenance of any obstruction affecting navigation or flood control on the Tennessee River system.

That expressly includes:

  • Docks, piers, boathouses, boat lifts and mooring
  • Shoreline stabilization
  • Channel excavation and fill

Modifications to an existing facility require a new permit.

What it costs

TVA’s application fee for minor shoreline alterations — residential docks, piers and boathouses — is $1,000.

Major activities (community docks, commercial marinas, launching ramps, dredging, bridges, utility crossings) carry the same $1,000 initial fee, and applicants may be charged for costs exceeding it. The underlying fee schedule at 18 CFR Part 1310 permits $100 to $5,000 depending on administrative cost recovery.

Timeline

How long it takes

TVA states it strives to issue permits for minor construction within 100 days, and that timeframes can extend to 120 days.

Permits expire if construction has not begun within 18 months.

The 60-day rule

Permits do not transfer with the deed. A new owner must apply within 60 days of purchase, even when the dock already exists and was permitted for the previous owner.

This is the single most common permit problem on lakefront closings.

18 CFR §1304.204

Size and placement limits

  • Maximum footprint 1,000 sq ft; 1,800 sq ft in an “area of preexisting development” — a subdivision recorded before November 1, 1999 with a TVA-permitted facility, or within a quarter-mile of a facility TVA permitted before that date.
  • Access walkways are not counted in that area, and must sit within a rectangle at the lakeward end.
  • A dock and its walkway may not extend more than 150 feet from the shoreline, or more than one-third the distance to the opposite shoreline — whichever is less.
  • Guntersville-specific: fixed piers and docks here must have deck elevations at least 18 inches above full summer pool. Most other TVA reservoirs require 24 inches; Guntersville, Pickwick, Wilson, Wheeler and Nickajack are the 18-inch group. §1304.204(d)
  • In subdivisions recorded after November 1, 1999, docks must be at least 50 feet from a neighbor's dock. If an owner controls less than 50 feet of shoreline frontage, TVA limits overall width.
  • Access walkways over water and internal walkways inside boathouses may not exceed 6 feet wide.
  • The vegetation and access corridor is capped at 20 feet wide. §1304.203(b)

Boathouse and enclosure rules

  • Roofs are allowed on boatslips. Covered slips may be open or enclosed with siding.
  • Covered docks, boatslips and boathouses may not exceed one story.
  • A second story is allowed only as an open deck with railing — no roof, no siding, no screening.
  • Enclosed space is limited to water-use equipment storage, maximum 32 sq ft outside dimensions.
  • No living space, no sleeping areas, no toilets, no sinks.

Flotation rules

  • Unencased foam flotation may not be used for new construction, repairs or replacement.
  • All unencased flotation must be removed and replaced by December 31, 2031.
  • Flotation within 40 feet of a fuel line must be 100% impervious to water and fuel.
  • Used plastic or metal drums are prohibited.
  • Flotation must be commercially manufactured for marine use and must not crack, peel, fragment, waterlog or lose beads.

Dredging and channel excavation

  • Maximum 150 cubic yards per individual boat channel.
  • Sized only to reach 3 feet of depth at minimum winter elevation.
  • Side slopes of 3:1 or flatter.
  • Excavation must be done during reservoir drawdown, when the bottom is exposed and dry.

Other permits you may need

TVA states you may also need permits from the state water quality office and/or the US Army Corps of Engineers, and that TVA may not be able to issue a 26a permit until a water quality permit or waiver is in hand.
